This document is also known as Responsible Declaration of 2nd Occupation and is requested as a responsible statement.
Why do you need a Certificate of Habitability in Murcia?
The procedure known as Certificate of occupancy has ceased to be used, being replaced by the Responsible Declarations of First and Second Occupation. Responsible Declaration of Second Occupation It must be submitted when you intend to contract services such as water or electricity, or sell your home, functioning as a renewal of the previous procedure. This procedure allows a technician to periodically check the condition of the home, thus avoiding substandard housing.
What do I need to obtain my certificate of occupancy?
In the Murcia City Council, the habitability certificate corresponds to the following procedure:
Responsible declaration of first and successive occupations of buildings. In our case it is second occupation.
To get the certificate of second occupation the Murcia City Council ask for the following documentation:
- Application according to the established model. downloadable here:
- Annex first and successive occupations
- Photocopy of the DNI, passport and NIE of the owner and the legal representative.
- Proof of payment of the Fee.
- Property deed or simple note.
- Graphic consultation of cadastre.
- Old water and electricity bills.
- Certificate of habitability and age in homes prior to 1990.
The rate will depend on the property, you will have to sign an authorization for me to request it on your behalf. After obtaining the payment letter, I will send it to you so that you can make the transfer and send me the receipt.

Is the certificate of habitability mandatory in Murcia?
The Responsible Declaration of 2nd Occupation It is a mandatory requirement for renting or selling a home in the Region of Murcia. Therefore, it must be valid if you intend to sell the property for residential use. However, if the property is being sold for the purpose of carrying out a complete renovation, it would not be necessary.
What are the requirements to obtain a certificate of habitability in Murcia?
The requirements to obtain the habitability certificate in Murcia are marked by the order Order of February 29, 1944
Some of these requirements include:
- Minimum surface area of 36 m².
- The home must have a living-dining room, at least one bedroom, a kitchen and a full bathroom.
- All rooms must have ventilation to the outside, with the exception of the bathroom.
- Have a water heater
- Have a kitchen with a stove and smoke extraction, or a window attached
- Keep the carpentry in good condition
- There should be no raised slabs, holes in the ceiling, walls or partitions (Cleanable surfaces)

FAQ Frequently asked questions about the Certificate of Habitability in Murcia
Because it's a Responsible Declaration, the process is considered effective from the moment it's submitted. Therefore, by registering the process in your name, the form itself becomes valid as a certificate of habitability.
The Certificate of Occupancy, the Responsible Declaration of Second Occupancy, and the Second Occupancy Certificate/License are often used interchangeably; all of these terms are commonly used to refer to the same document. To be able to process this Responsible Declaration, the home must have been legally built and the first Certificate of Occupancy must have been issued at the time.
In the absence of more formal documentation, old utility bills such as water or electricity are accepted to prove that the home once had a certificate of occupancy.
The Certificate of Habitability is valid for 10 years or until one of the following cases occurs:
It is necessary to re-contract water, gas or electricity supplies.
The sale or transfer of the property takes place.
Once it has expired, it must be renewed by submitting a new Responsible Declaration of Second Occupation to the Murcia City Council.
The only means of unequivocally proving ownership of a cadastral reference is the IBI (Property Tax) receipt. The city council requires this to prevent possible errors in the registration process, such as accidentally using the reference of a neighboring property.
