A certificate of habitability is a document issued by a City Council that certifies that a property meets the conditions to be inhabited.

Each municipality usually requests different documentation, being in all cases necessary a certificate of habitability issued by an architect.

What is a certificate of habitability used for?

The habitability certificate has the purpose of guaranteeing the habitability of the dwelling, for which its health, hygiene and condition are taken into account. In addition, if the habitability certificate is in order, we can register the electricity, gas and water services. It is also essential to sell or rent a home.

Types of habitability certificates

There are three types of certificates of occupancy according to the antiquity of the house:

  1. identity card first occupation: Corresponds to newly built homes.
  2. identity card second occupation: Document corresponding to existing homes. It is the renewal of the first occupation certificate. It has an expiration period that depends on what is established in the municipal regulations.
  3. identity card first rehab occupation: It is carried out in those houses in which a rehabilitation of the same has been carried out, since they must be adapted to current regulations.

¿What do I need to apply for my habitability certificate??

The certificate of habitability is granted by the Town Hall of the municipality where the house is located. Although there are usually slight changes, the following documentation is usually requested:

  • Proof of payment of the fee. (depends on the municipality)
  • Photocopy of the declarant's ID.
  • Photocopy of the ID of the representative.
  • Photocopy of the deed of ownership or lease.
  • Cadastral reference of the house.
  • Certificate of habitability signed by an architect.

When is a certificate of habitability not necessary?

There are exceptional cases in which the certificate of habitability it is not mandatory. In a home sale or transfer, as long as it is not a new construction, those involved in the operation may agree not to carry out the certificate for the following cases:

  1. When you intend to reform or demolish the house. In these cases, the intention of the future owner to renovate or demolish the property must be recorded in the registry, since the exemption from the obligation to deliver the certificate depends on it.
  2. When the property is not a home. In this case, those involved must expressly acknowledge it.
